Hi All,

I am new in this forum. I would like to ask information about the UAE Law about child custody and filing a case against my wife and in-laws.

I have been staying in UAE from last 5 years. I have a son of 3.5 years old. My wife's attitude since the marriage has been very rude and abusive. Her parents always encourage her to keep a hold on me by creating drama and rude behaviour. Recently she created a scene where she called police and said that I beat her where I never beat her. Police didnt come. Things got settled afterwards. One day her brother came and told me that tomorrw is my birthday and i want to take your wife and my son. I gave permission for 2 days. The 3rd day I called my wife when she is coming back. She told me when my father will allow me then I will come and then I came to know that she took her passport and my son's passport with her along with my marriage certificate and all the gold from my house and she said that its my stuff and I will keep with me. I called her father about it and he told me that I told her to do this and I will come to meet you and talk with you.

Now its been 75 days, her father didnt come and I have not seen my son from last 75 days. They even filed a case in the family department in Abu Dhabi regarding the settlement of this case.

I would like to ask whether I can file a case against my wife and my in-laws in UAE as she took things without my permission and information since she and my son are on my sponsorship. I would like to meet my son and bring him to my flat in Dubai since my in-laws stay in Abu Dhabi. Kindly let me know what the police and law says about this?

You need to speak to a lawyer to get the correct information as to what the law says. This is very important. If you are worried about the cost of speaking to a lawyer, I believe you can get one hours free advice from some. I'm sure I've seen this advertised. I will have a look and see if I can find the advertisement.

If you google free legal advice in Dubai, you may get some information to help you.

I would like to ask what are my rights in this as I don't want to go for divorce becoz of my son's future but at the same time I would like to know what I can done in this situation within UAE law? Actually its from Abu Dhabi Family Guidance Department which is under Abu Dhabi Judicial Department. This service provides religious and legal solutions to family disputes to reach an agreement that satisfies all parties.They will try their best to resolve the issue but my concern is that whether my wife who is under my sponsorship with my son also can take her and my son's passport without my permission and information and also took all the gold and my marriage certificate copy? Also whether my in-laws keep her at their place without my permission where I cannot meet my son or they are blackmailing me by keeping my son with them? Just kindly give the answer of this please. I am asking this very simple question.

for your son if he under age shouls stay with mother and you spend one day in the week with him if your wife devorce

your wife you should send her notice to come to you home money and gold shold report in police
