A Nakheel Story Jan 21, 2007
On 6th of September 2006 the day “ Nakheel ” launched its new community called “ Jumeirah Park ”, I was so lucky so I could get in line from 5:30 in the morning we bought a small three bedroom villa.

To follow the sales regulation we booked the property, I cut a cheque for 10 percent of the value and submitted the cheque to sales executive. He opened a new file for us and assigned a customer file number to us. He attached the cheque to the “Booking Confirmation” and accompanied us to the “customer service” desk on the other side of the sales center.

The cheque was submitted to the “Customer Service” and we got receipt. DONE!
But after two months to our surprise we found that the same property has been sold more than once!! Without any notice.

First they claimed that it was a computer mistake and they offered us to get a large three bedroom which was not affordable for me. However, after I refused to accept their new offer, they started to behave aggressively and the “Customer Relationship manager” removed my papers from the file.

I asked for a higher manger and they guided me to “Sales Department Manager”, who returned me to “Customer Relationship manager” once more. He got more aggressive this time and told me that Nakheel is selling nothing, and mentioned he had the ability to terminate my purchase on his discretion even if I had payments for more. Also he told that no longer there is any record of my payment and if I get an attorney he will terminate this sale immediately. He told me that Nakheel is so big so NO ONE can sue it.

The next day, a lady called my home and in clear words told my wife that if we go to go to police, even if we proceed and win the case, they are going to make troubles for my family and they will through us out of the country since Nakheel has this power!

I got original receipt for the money with Nakheel’s seal and sign under it. I got the original “Booking Confirmation” with the sales person signature on the bottom of it with project name and property code and detail on it, I got the payments cheques copy, I got my bank certification shows that the cheque has been cashed one week after sale. We got lawyer and he sent Nakheel a demand letter. After two more reminders and 16 days (3 months after the sale) the Nakheel’s General Consular replied that we can either collect the original money or to use the fund to purchase an alternative property via Customer Services Center again.

When I went into the customer service to see what the alternative could be with the general consular letter in my hand, they started to push us to sign a letter that we want to cancel the previous purchase for a new one, without even informing us of their availabilities.

We refused to sign anything without first be ensured of what they are going to offer, and called the general consular to ask him to let them first show us the availability and I will provide whatever letter they want at the same time. To our surprise he said that he didn’t ask for such a letter.

The next day, a person from Nakheel called my mobile and told me that they are going to do something very nice in my favor in case I submit the requested letter. I contacted our lawyer and we prepared a letter to ask them show us what they have, without ignoring our previous rights and I submitted the letter.

It took 12 days to get the reply as they were playing with my time, passing me to the next day, every time I walked into the Nakheel.
The answer was a letter thanking me for choosing their prestigious Jumeirah Park project and I only have to get the money back and for further queries I can visit their website or call the call center! I referred to the general consular’s letter with his signature under it with the option of an alternative property and they said there is no value for the letter(!). And now after 12 more days after latest reply, still there is no proper answer on why or how and when Nakheel wants to finish this misery to my family.

During all these time I tried to meet the CEO or anyone responsible to this mess without luck as the receptionist is saying the CEO is not getting himself involved.

According to other people’s experiences, the jurisdiction system is slow and it may takes more than a year to get through it and I need to deposit 15% to start a case.
So,
From early morning till evening I am running here and there with a lot of proves in my hand to return our right back in our home…
Every day I am not only loosing my business opportunities, but also I am going to loose my current clients since I am unable to finish their works or answer their calls.
I very well realize Nakheel is a big company, with its big feet over our shoulders, and it is very busy, so they do not feel shame to not answering me properly.
I also very well realized that God is very busy, receiving millions of requests every moment.
I also have no answer for my son: why am I shouting at him to go to his bed all these nights?” I could not write how it would feel when I found he has through away the painting he made on the “Jumeirah Park Small three bedrooms legacy villa” brochure to tell me how he like his room which his father promised, but even he failed to sell it to fulfill his other requirements…

I never forget Nakheel and 6th of September.

that is outrageous :x
and it seems they took very seriously the matter about making things dificult for u and ur family...as that lady who called u saied.
in the Jumeirah Park website it's all nice and shiny what a shame that the reality is quite the contrary.

they rely on their influence and power as a big company to threat ppl
these b a s t a r d s need to be punished. :evil:

That is a disturbing story. IT seems like your best way out of this at this stage is the involvement of a higher up in Nakheel (or Dubai World) did you try getting a hold of the customer service manager rather than the sales managers ?

It is possible he already spoke to that manager, considering the threats he received. I think he should take his money back and cut his losses, and write letters to newspapers. I don't think this country has lawyers anywhere near as good as Johnnie Cochran.

Being a Nakheel customer myself, I entered the game at a late stage and used an agent to do my dealings, never having spoken to them directly yet. Judging from this, buying into projects at an early stage here still seems to be risky.

Behrooz,

I suppose you thought about this before you posted but your choice is rather simple: sue Nakheel. However, I imagine that Nakheel may sue you first for Libel. I suggest you contact your lawyer to explain all of this - Libel and/or your rights (unless he/she has explained that to you)...

well first sorry for what happened.

it really is outrages and very unprofessional.

Going with a case against Nakheel is gonna cost you time and money, the end result might be nothing. Suggest you take your cash back and leave the matter, good luck hope things work out for you.

Dear Kashif;

Also they wrote me that they are returning the original money despite to what is my request, and also it is quite unfair

BUT

HOW I CAN GET BACK EVEN THE ORIGINAL MONEY? they are not corresponding. They just keep me sat on the chair for hours until the end of the working time.

The last thing I am going to do is trying to meet H.H. Sheikh Mohammed or I would taking a refugee by sitting in front of Nakheel entrance for nights and days, until someone answer me.

My health and my body are the latest weapons that I have to save my children's right. And if they are continue to ignore me I have no other choice.

I suggest you goto the press - contact one of the leading newspapers. Stories like these deserve to see the light of the day. At the very least, it would evoke public sympathy, and that in the long run would affect sentiments towards Nakheel.

i dont know y ppl invest in dubai seriously. you can go to england n invest there in property or wots better you could go to pakistan or india for investment. n oh yeh emaar is in Pakistan especially Gawadar the new port that will finish Dubais port thats wot ppl are saying.

y invest in dubai. the property isnot urs. ok THEY say it is but is the LAND ur villa is standing on is that urs ;) tommorow when THE sheikh wants to build a road there wot will happen u ll get compensation n thats it.

actually the same millions could have been made in other markets.. property prices in pakistan are doubling almost every year. In london, 10-15% can be gained in a year if the location is good.

my family buys quite alot of property, we sure have made our minds not to invest anymore in dubai, london seems to be a muchbetter proposal.

few years back my father bought 10 appartments in london, each in the range of 400,000 - 500,000 pounds. Today they are worth alot more, not only that the pound has appreciated against the dirham by about 30% and is expected to gain further. I guess investment there is still a very good idea, since good land there is scarce. Supply is short demand is high, and ppl have rights within that country.

Compulsory purchase orders regarding land are possible in most countries in the world and generally dealt with using market rates. This is not the case or subject in this thread.

There is something fishy about this stoery. behrooz - if it has happened as you have said it has happened - then this is unfortunate and i hope it is resoved quickly.

if not heed the dawgs words as libel is serious business

I e-mailed the story to Emirates Today and 7Days. It seems they are not allowed to publish bad stories as officials request them to. (I heared), however I am going to submit the story to H.H. Sheikh Mohammed office tomorrow as my first thing, and I will start sitting in front of Nakheel from tomorrow noon if they don't give me any other choice with the receipt in my hand.
I would appreciate if people can support.

This is the latest response I got from Nakheel from Mrs. Manal Shaheen who is Director of Sales, Marketing and Customer Service:

"We are aware of your publicizing this case on various web sites, inviting publicity and criticism. We are concerned at the inaccuracies of statements attributed to you that can be regarded as defamatory and advise that in the event that such false or misleading statements are continued we reserve our right to take the appropriate action."

BTW, I believe that this is my right to speak out my problems and its public right to know about such incidents. Thats why media are created!

If anyone has any connection to media please let me know.

i hope you are able to prove everything you have said about them so far if this were to go to court, otherwise, well --- your screwed.

Isn't Nakheel notorious for bad customer service? Why is defamation a particular concern here? People cyper-talk smack about companies all the time...

I've heard so many bad things about Nakheel, including that they artificially inflate their profits "on paper" to attract more investors...anyone know if this is true? :P

both Emirates and Nakheel are privately held companies that dont need to inflate profits to attract investors.
