In problem with bad used car.PLEASE HELP May 08, 2012
Recently I purchased a Toyota Corolla Station Wagon 1.8Xli from a used car dealer in Dubai.The used car dealer claimed that the car is accident free(The car had open cracks near the bonet and near lights).We have paid the money for the car,but the car is still not under our name.It has been exactly 9 Days since we purchased the car.Normally the car is driven by my dad who drives in range of 80-100kmph.

Today when I took the car for a highway drive @120-125kmph the car heated.And suddenly black smokes began to come out of the car.Before purchasing the car we had taken the car to Tasjeel(it passed) on the day of deal and also tried it but never on highway.It has been 9-10 days and still the car is not under our name.Can we claim the amount as the car is not in the condition which he told us it is in ?

It's really a big investment for me as a student ? And on the top of it the car's air filter casket was also broken.I spent some of my extra cash to repair all that-800Dhs and now this ?

On the cars phataka(identity card) it is written that the car is toyota corolla 1.6.We also had in condition that it would be changed when we change the ownership to my name.Because of this I have been driving car under some other persons name.

According to the used car dealer the other party(the seller of the car) is in his home country and the change in the ownership of the car will be done after he comes here(He told us that he will come in 2 days.He has not come still)The car right now is smoking badly.is it my fault that I took car on 120 kmph(Come'on that the speed limit on highway).Used car dealer has also told that he has sent money to India.


My main question is-What should we do about this ? Is there a way through which we can sort this ? Can we call police in this matter ? Can the deal be off ?

No lemon laws here buddy, best you can do is negotiate. Its up to your negotiating skills now. And this is going to be hard to swallow but it was a dumb move on your part to pay for the car before the ownership was transfered And even if you transfered the ownership you would still be stuck with a car that overheats, another bad move on your part for not throughly checking out the car before paying for it.

Anyways, corolla bits and bob are cheap and overheating is usually not a big issue, have it fixed and hope for the best, well at the very least dont put anymore money into it before and pray for the best.

A tough lesson learnt but hopefully next time you'll be more carefull

Thanks for the reply.Yes we are trying to negotiate with Him.We checked the car on cIty streets and it was just making normal sound which we thought we can repair it.But when I took the car on highway,the car smoked heavily and overheated.Really bad time for me as it was my first car.Hopefully the ownership is not transferred yet so we can talk to dealer abt what can we do abt this car and negotiate with him.The engine(costs 3500) I guess needs to be replaced and we are ready to pay him for that and give the car back to him.

You got conned - you bought a car with a leaking head gasket. There would have been subtle signs during your test drive, but apparently you missed them. The mechanic will need to remove the head, machine it flat and reinstall it with a new gasket.

3500 is a bit expensive to do all that, you can probably get him down to 2000-2500.

The engine doesn't need to be replaced - but as the saying goes, a fool and his money will soon be parted.

"car's air filter casket was also broken.I spent some of my extra cash to repair all that-800Dhs". That what was broken? Air filters don't have a casket (or a gasket). Your mechanic must love you.

The problem is in the engine.The fumes were coming out of engine and the car was smoking black fumes on the road.The engine will be replaced making it a completely new car.Replacing gasket and stuff will cost 2000-2500 and on that there is no safety.So paying 1000 extra and getting a new engine is a better option I guess.

Anyways thanks for the advice though

You aren't going to get a new engine for that amount of money. Do you mean a second hand engine from a wrecked car? Is this what they want to do? If so, there is a risk that there could be problems with the replacement engine.

Apparently the car wasn't smoking when it passed Tasjeel. How many km's does the car have? Is the engine noisy or quite? Does it make any tapping noises?

There are too many agents in this country - people who want to sell things they don't own for someone else - expect you to pay cash up front & trust them that you will eventually get the item from the owner. If you deal with this kind of people - you are making it so easy for people to cheat you. Not everyone in the world is honest.

Do you have any idea how much money the owner owes in fines? Better look it up online, it might be more than the car is worth.

One thing that will save you a lot of money is don't get emotional when you are buying a car. Always be ready to walk away if things go wrong.

When the seller asked you to pay in full before the car was transfered to your name, you should have demanded your deposit back and asked him to call you when the owner was back in the country. There are plenty of cars for sale out there.

Thanks Blueshift for helping me through.Right now we are trying to put new engine into the car(Used car engine) then my dad will decide whether to keep car or give it to the car dealer or sell it.We also found out that the previous owner had done some changes inside the engine(sigh.)

I got to learn lot out of this deal.The best thing is I will never in my ''whole life buy a used car''.

Once again Thank alot,my exams are going on as of now and this car came into my life.Worst time in my life-paper too went bad coz of this car(was tensed as all this happened because of me :( .Hope people like these(like previous owner) don't come in anyone's life and people check throughly the car @150kmph before buying it.

Well I'll never buy a new car - they lose about 10% in value as soon as you drive out of the showroom.

A lot of new cars have trouble in the first year, but usually it gets fixed under warranty and it will be better in the second year.

Buy at 2 years and sell at 5 if you want a car in like new condition for a lot cheaper than a new car.

If frankly telling telling you then never go for a second hand car ever. they dont perform well at all as compared to a new one. This is my personal experince and another thing want to tell you buddy you are conned so take care in future. obviusly a person who is selling his vehicle will only sell if the vehicle is not in a good condition.

DevangThanki ,proper valuation of car is more important Most of the people don't know the actual value of their car...always purchase used car from a certified dealer and inspect it thorougly..i think you should ask a lawyer..
